Venice Estate Planning Attorney

Plans for Venice Island condos, Wellen Park homes, snowbirds, and retirees.

A Venice Island condo, a Wellen Park home with CDD obligations, a northern-state domicile, or storm-related insurance proceeds can change how the plan should be written. We prepare Florida estate plans that account for the property, the family, and the documents that will be needed later.

Estate Planning in Venice Starts With Local Realities

Venice has one of the oldest resident profiles in Florida. The median age is 69.2, and more than half of the city’s residents are age 65 or older. That affects how often families need wills, trusts, health care powers of attorney, domicile documents, and probate planning.

The property mix adds another layer. Venice Island condos bring association and estoppel issues. Wellen Park homes may carry CDD obligations. Snowbirds from New York, Ohio, Michigan, and other states need Florida domicile planning that can stand up later.

Storm recovery now belongs in the planning conversation, too. Hurricane Helene hit Venice in late September 2024, and Hurricane Milton followed less than two weeks later. Insurance proceeds, rebuild authority, repair decisions, and transfer timing may need to be addressed before the documents are signed.

Florida procedure changed on January 1, 2025, when CS/HB 923 took effect. Sarasota County recording rules now matter for orders admitting wills and beneficiary orders tied to real property.

Proudly Serving Venice and Our Surrounding Communities Today

Buckman, Buckman & Castellano, P.A. serves estate planning clients across Venice, including Venice Island, historic downtown, Wellen Park, Venetia, Venice Golf & Country Club, and South Venice.

The firm also works with families in Nokomis, Osprey, North Port, and nearby Sarasota County communities where retirement planning, property ownership, and probate concerns often overlap.

Venice residents should note the distinction in the local court. The South County Courthouse on South Tamiami Trail handles certain southern Sarasota County matters, but probate filings go to the Silvertooth Judicial Center on Ringling Boulevard in Sarasota.

Venice planning often involves older homeowners, snowbirds, condo owners, veterans, retirees, and families with adult children outside Florida. Those details affect who should have authority, how property should pass, and whether the plan is ready for later administration.

Buckman, Buckman & Castellano, P.A. has served Sarasota County for decades. Allie has argued before the Florida Appellate Court in matters involving the right to direct an estate plan.

Estate Planning Issues That Come Up Often in Venice

Venice planning usually starts with the asset and the person who may later need authority. A condo, Wellen Park home, snowbird estate, veteran benefit issue, or storm claim can each require different drafting.

  • Trust funding for Venice Island condos affected by Chapter 718 association procedures.
  • Wellen Park CDD and HOA obligations are passing with the property.
  • Florida domicile planning for New York, Ohio, and Michigan snowbirds.
  • Aid and Attendance or VA-benefit planning for older Venice veterans.
  • Helene or Milton’s insurance proceeds are addressed in trust language.
  • ESOP and retirement-benefit coordination for PGT Innovations and Miter Brands employees.

These issues should be reviewed before documents are signed. A Venice Island condo is not planned like a Wellen Park home. A snowbird estate is not planned like a year-round South Venice homestead. Talk with Allie before a standard form leaves title, benefits, or residency questions unresolved.

Documents Every Venice Estate Plan Should Include

  • Last Will and Testament
  • Revocable Living Trust
  • Durable Power of Attorney
  • Designation of Health Care Surrogate
  • Living Will (advance directive)
  • HIPAA Authorization for medical records
  • Declaration of Domicile under §222.17

These documents do different work. The will and trust address transfer after death. The durable power of attorney, health care surrogate, living will, and HIPAA authorization address authority during life. The Declaration of Domicile supports Florida residency when another state may later question it.

For Venice clients, domicile and incapacity planning often deserve extra attention. Snowbirds need more than a Florida address. Older retirees without nearby family may also need a pre-need guardian designation under §744.3045, especially when no one local can step in quickly.

How to Start Your Estate Plan with Our Venice Firm Today

Bring the records that show what you own and who is already named. Useful items include deeds, Wellen Park HOA or CDD statements, condo records, beneficiary statements, prior wills or trusts, and a short family summary.

The first meeting is used to identify what needs legal work before drafting begins. Allie reviews property title, family decision-makers, health care authority, domicile, beneficiary records, and whether any current plan still matches your life.

The document set is then narrowed to what the situation requires. That may include a will, a revocable trust, a durable power of attorney, a health care surrogate, a living will, a HIPAA authorization, a Declaration of Domicile, a Lady Bird deed, or a trust amendment.

Signing is handled in accordance with Florida witness and notary rules. When follow-through is needed, our office addresses deed retitling, beneficiary updates, trust funding, recording, and Wellen Park CDD coordination so the plan is usable after signing.

How We Build Your Venice Estate Plan

The work begins with a title and authority. Who owns the property, who can act during life, who receives control after death, and whether the deed, trust, beneficiary form, or account record points in the same direction.

Venice property can require different planning even within the same family. A Venice Island condo, a Wellen Park home, a South Venice rental, and an out-of-state cabin may not belong in the same transfer structure.

Residency is handled directly, not assumed. For snowbirds, domicile planning may involve §222.17, voting, driver’s license records, tax filings, and the practical question of where the client actually lives most of the year.

Storm claims and repair authority are also addressed when relevant. If Helene or Milton’s proceeds are pending, the plan should state who controls the claim, who can sign, and how the money should be used or distributed.

Where outside coordination is needed, we handle it. That may involve Karen E. Rushing’s Clerk’s Office, the Sarasota County Property Appraiser, a Wellen Park CDD administrator, financial advisor, CPA, or condo association.

Estate Planning in Venice, By the Numbers

Venice probate filings move through the 12th Judicial Circuit in Sarasota, even though the South County Courthouse is inside Venice city limits. Summary administration may be available under §735.201 when qualifying non-exempt assets fall below $75,000.

The age profile drives much of the planning work. Venice has a median age of 69.2, and 50.8 percent of residents are 65 or older. That makes powers of attorney, health care authority, trust funding, and probate avoidance regular concerns.

The property values also matter. Median household income is $76,755, and median home value is about $434,700. Venice Island condos, Wellen Park homes, South Venice rentals, and seasonal residences can each require different title and transfer planning.

What Venice Families Ask About Estate Planning

Ready to Protect Your Family’s Future?

Request a free consultation
Does the South County Courthouse in Venice handle probate?

No. Venice probate filings go to the Silvertooth Judicial Center on Ringling Boulevard in Sarasota. The South County Courthouse handles certain civil and criminal matters for southern Sarasota County, but not probate. Karen E. Rushing’s Clerk’s Office handles probate recording.

How do I make Venice my legal domicile after retiring from NY?

Start with a Declaration of Domicile under §222.17. Then align the records: Florida driver’s license, voter registration, tax filings, mailing address, and actual time spent in Florida. Domicile should be consistent across the paperwork, not just stated in one document.

Can a Wellen Park CDD obligation pass to my heirs?

Yes. CDD assessments run with the property. A trust can transfer title without probate when properly funded, but the assessment remains tied to the parcel. The estate plan should specify how those charges will be handled after death.

How do Hurricane Milton insurance proceeds work if the owner died before payout?

The proceeds become part of the estate or trust administration. If the home was owned individually, the personal representative usually pursues the claim through probate. If the home was in trust, the successor trustee may handle the claim.

Can a trust avoid probate on my Venice Island condo?

Yes, if the condo is properly funded into the trust. The trust can transfer the unit after death without filing in the 12th Circuit. For some non-homestead investment condos, a Lady Bird deed may be a simpler option.
