Englewood Probate Attorney

Venue, filing, and administration on both sides of the county line.

Englewood probate starts with venue. A Sarasota-side address sends the estate to the 12th Circuit. A Charlotte-side address sends it to the 20th. Once the right court is clear, the file still has to deal with the will, creditors, assets, storm claims, and discharge. We handle the filing and the administration.

Probate for Englewood Estates on the Sarasota-Charlotte Line

Englewood probate begins with one practical question: where did the decedent legally live? The CDP has about 23,224 residents and crosses the Sarasota-Charlotte county line, so the wrong venue can delay the estate before it starts.

The property then drives the case. A mobile-home estate, Manasota Key property, mainland homestead, or bank-account-only estate may each point to a different probate procedure.

Storm damage has become part of local probate work. Hurricane Helene struck on September 26, 2024, and Hurricane Milton followed on October 9, 2024. Open insurance claims, repair disputes, and damaged-home sales now appear in many Englewood estate files.

The Florida recording procedure also changed. CS/HB 923 took effect on January 1, 2025, requiring Clerks of Sarasota and Charlotte Counties to record certain probate orders in the land records.

Allie R.B. Castellano leads probate matters at Buckman, Buckman & Castellano, P.A. She works directly with Englewood families on filings, venue questions, personal representative duties, insurance claims, and discharge.

Proudly Serving Englewood and Our Surrounding Communities Today

Our probate clients come from Manasota Key, Old Englewood Village, Dearborn Street, Englewood East, Grove City, Rotonda West, Placida, Cape Haze, Port Charlotte, and Venice.

Englewood cases are split between two courts. Sarasota-side estates go to the 12th Circuit at the Silvertooth Judicial Center on Ringling Boulevard, with Karen E. Rushing’s Clerk’s Office.

Charlotte-side estates go to the 20th Circuit at the Charlotte County Justice Center in Punta Gorda. Roger D. Eaton’s Clerk’s Office also operates the local branch at 6868 San Casa Boulevard for certain services.

The venue question matters before anything is filed. It affects the clerk, the judge, the probate forms, recording, homestead records, and the administration timeline.

Buckman, Buckman & Castellano, P.A. has served Southwest Florida for decades. Allie focuses on Florida probate and estate planning and has argued before the Florida Appellate Court.

Probate Issues That Come Up Often in Englewood

Englewood probate is usually shaped by county line, asset type, and who has the authority to act. A small mobile home estate, a Manasota Key property, or a storm-damaged home can each require a different filing.

  • Venue decisions along the Sarasota-Charlotte county line
  • Summary administration for mobile-home estates under $75,000
  • Ancillary probate for out-of-state Manasota Key owners
  • Personal representatives collecting Helene’s or Milton’s insurance proceeds
  • Will contests or homestead issues involving manufactured homes
  • Formal administration with creditor claims and §733.607 authority

The procedure should be chosen before the family starts moving assets. A $60,000 mobile-home estate is not handled like a Manasota Key ancillary filing. A storm-claim estate may need authority before the insurer will deal with anyone.

Documents Every Englewood Probate File Must Include

  • Certified death certificate (long form)
  • Original last will and testament
  • Petition for Administration with the Clerk
  • Letters of Administration from the court
  • Notice to Creditors (publication and service)
  • Inventory of estate assets filed.
  • Final accounting and Petition for Discharge

These filings take the estate from opening to discharge. The death certificate will establish the starting point. The petition asks the court to open the file. Letters of Administration give the personal representative legal authority.

From there, the work shifts to creditors, inventory, accounting, and discharge. In Englewood, the original will must be deposited within 10 days under §732.901, and venue must be confirmed before the filing goes to the wrong clerk.

How to Open an Englewood Probate Case With Our Firm

Bring the death certificate, original will if one exists, deed for any Englewood real estate, mobile-home title, recent bank or brokerage statements, beneficiary forms, and a list of known debts.

The first legal step is venue. We confirm whether the estate belongs on the Sarasota or Charlotte side, then determine whether formal administration, summary administration, ancillary probate, or disposition without administration is appropriate.

Once the path is set, our office prepares the petition, handles the will deposit, and seeks the appointment of the personal representative when required.

The administration then proceeds through creditor notice, asset collection, insurance claim handling, homestead issues, inventory, accounting, and discharge. Storm-damaged property and mobile home transfers are handled within the same court process.

How We Handle Your Englewood Probate Case

The file starts with authority. Who may serve, what assets are in probate, what passes outside probate, which court has venue, and whether any creditor, beneficiary, or insurance issue is already creating pressure.

Then we match the procedure to the estate. A Manasota Key ancillary probate for an Ohio decedent is not the same matter as a small Englewood East mobile-home estate. A Rotonda West homestead file is not handled like a formal administration with storm-claim proceeds.

Our office coordinates with the proper Clerk, Sarasota or Charlotte Property Appraiser, insurance adjusters, financial institutions, out-of-state probate counsel, and any association or mobile-home community involved in the transfer.

Families get direct updates at the points that matter: what was filed, what the court needs, what creditors have claimed, what the personal representative can sign, and what remains before discharge.

Probate Administration in Englewood, By the Numbers

Englewood probate filings are split between two Florida judicial circuits. Sarasota-side cases go to the 12th Circuit. Charlotte-side cases go to the 20th Circuit.

Summary administration is available in either circuit when the estate qualifies under §735.201. The $75,000 net-asset threshold often matters in Englewood because many estates involve modest mobile homes, small accounts, or exempt homestead property.

The CDP has about 23,224 residents, a median age of 66.9, and more than 55 percent of residents are 65 or older. Mobile homes account for about 24.5 percent of the housing stock, which affects title, homestead, and probate decisions.

Helene and Milton added another layer in 2024. Personal representatives may now need to collect insurance proceeds, work through repair issues, or sell storm-damaged property before an estate can close.

Englewood Probate Frequently Asked Questions

Which county handles probate for an Englewood resident?

The decedent’s address controls. Sarasota-side cases go to the 12th Circuit at the Silvertooth Judicial Center in Sarasota. Charlotte-side cases go to the 20th Circuit at the Charlotte County Justice Center in Punta Gorda. The San Casa branch offers certain local services, but not every probate step happens there.

How long does Charlotte County probate take for an Englewood resident?

Summary administration typically closes within 2 to 4 months of filing. Formal administration usually takes 6 to 12 months due to the creditor period, asset collection, and court requirements. Storm claims, will contests, or title issues can extend the timeline.

Does summary administration apply to a $60,000 Englewood mobile-home estate?

Often, yes. Summary administration under §735.201 may apply when the net estate value, excluding exempt property, is under $75,000. A manufactured-home homestead issue can affect what counts toward that threshold.

How are Hurricane Milton insurance proceeds handled in probate?

If proceeds are payable to the decedent, they become an estate asset. The personal representative may collect, negotiate, and direct those proceeds under §733.607, subject to the will, creditor issues, and court procedure.

Can a personal representative sell a storm-damaged Englewood home?

Yes, with proper authority. Under §733.612, the personal representative may sell real property if authorized by the will or court order. For storm-damaged property, the sale and insurance claim should be coordinated before distribution.
