How do I clean up a forgotten GDC lot in a parent’s estate?

Title cleanup runs through probate. The personal representative confirms the lot was in the decedent’s sole name, pulls the chain of title with the Sarasota Clerk, and clears any Ch. 197 tax-certificate or tax-deed history. If the lot has lapsed due to unpaid taxes, the estate may need to redeem it or accept a tax deed transfer. Then the lot can pass by devise.

Does the Wellen Park CDD assessment pass to heirs?

Yes. Under Ch. 190, a Community Development District levies both a bond debt component and an operating-and-maintenance component on the parcel, and both run with the land. Those assessments continue after the owner’s death and become estate expenses the personal representative must pay, or the buyer must assume. Trust drafting should account for them so no heir is surprised.

Where does a North Port estate file probate: Ringling or Venice?

Ringling Boulevard. North Port is in Sarasota County, and all Sarasota County probate filings are centralized at the Judge Lynn N. Silvertooth Judicial Center on Ringling Boulevard in Sarasota. The South County Courthouse on South Tamiami Trail in Venice is closer to North Port for certain civil and criminal matters, but does not handle probate.

Can a young North Port parent avoid probate with a trust?

Yes. A revocable living trust funded during your lifetime keeps your home and accounts out of the 12th Circuit at death. Parents of minor children should also sign a pre-need guardian designation under § § 744.3021 and 744.3046 so the court has a named guardian on record. Together, those two documents handle most of the estate concerns young North Port parents bring us.

How does a Hurricane Ian insurance claim transfer to the estate?

The claim becomes an asset of the estate at death. The personal representative steps into the policyholder’s shoes, communicates with the carrier, and collects any unpaid proceeds. Either way, trust or will language can direct how those proceeds are used, whether for rebuilding, distribution, or both.
