What happens to the GDC vacant lots my parent never built on?

Each lot titled in the decedent’s sole name must be handled through probate. The personal representative confirms the title, checks Sarasota County records, reviews any Chapter 197 tax certificate or tax deed history, and then transfers or devises the lot as allowed.

Can the personal representative collect a Hurricane Ian or Milton claim?

Yes, once Letters of Administration are issued. The personal representative can contact the carrier, provide certified Letters and the death certificate, pursue the claim, and collect unpaid proceeds for the estate. If a trust owns the property, the successor trustee may handle the claim instead.

How does §744.3021 minor-child guardianship work after a young parent’s death?

If a pre-need guardian was named under §744.3046, that person has priority. If not, an interested person may petition the 12th Circuit under §744.3021. The court decides guardianship after notice and hearing, and probate may need to move at the same time.
